Criminal law or Penal law encompasses the rules and laws which have the potential to punish any criminal activity that causes harm to the general public. Criminal law is all about imposing punishment for crimes such as murder, rape, aggravated assault etc. This law is put into effect by the government of every nation.
Depending on the offense, criminal punishment may incorporate fines, loss of liberty, death penalty etc. By and large, laws are made for the betterment of the society as well as nation. The spirit or strength of law keeps the justice alive. Criminal law is enforced with four prime goals- Rehabilitation, Incapacitation, Deterrence, and Retribution. Rehabilitation aims to convince an offender that his conduct was wrong and against the moral values. It also intends to convert an offender into a valuable member of society. Incapacitation is implemented to keep criminals away from society so that the civic is protected from their delinquency. Deterrence is designed to simply inflict severe punishment to an offender and discourage him for his offence. Individual deterrence aims to prevent the occurrence of any type of crime. Retribution is a term which aims to balance between the sufferings of a victim and the sin of an offender.
The misdeed of an offender is undesirable and needs to be punished, yet there are some limitations in imposing punishment. The United States Constitution’s Eight amendment depicts- no cruel punishments, no excessive fines etc.
Criminal law aspires to curb unlawful killing and unethical behavior from every nation. It forbids adverse acts. Offensive conduct should be protested and punished in order to uphold the dignity of people. As it is rightly quoted-“Injustice anywhere is a threat to justice everywhere”.
